As the American economy moves out of the pandemic and continues to evolve, it will be important for any independent contractor test to recognize new and innovative work arrangements. New technologies have altered the way that people work. This was a trend that was already starting before COVID-19, but it has accelerated rapidly in recent months. Worker flexibility has also been a crucial conversation since the beginning of the pandemic, with firms rethinking how work gets done, often utilizing new tools or arrangements. Therefore, it is crucial that the Labor Department adopt policies that foster innovation and provide flexibility to workers and businesses. We encourage the Department to implement the final rule with an eye toward the future and in a way that will not hinder any new methods of work.
